Terms and Conditions
Promoter/Platform Operator: Fronk Enterprises Pty Ltd, ACN 669 088 779, ABN 24 669 088 779, of North Adelaide SA 5006 ("Rewardom", "we", "us", "our").
These Terms and Conditions ("Terms") govern:
- your access to and use of the Rewardom membership platform, mobile applications, websites and any related services (the "Platform"); and
- your participation in any promotional prize draw, giveaway, competition or other promotion made available by Rewardom on or through the Platform (each a "Promotion" or "Prize Draw").
Each Promotion is also governed by a separate Promotion Schedule published on the relevant draw page or campaign page (the "Promotion Schedule"). If there is any inconsistency between these Terms and a Promotion Schedule, the Promotion Schedule prevails for that Promotion, but only to the extent of the inconsistency and only insofar as the Promotion Schedule complies with these Terms and applicable law.
1. Rewardom in a nutshell (compliance positioning)
1.1What Rewardom is. Rewardom is a paid membership rewards club for Australian consumers. Members pay a recurring monthly subscription fee for a bundle of member benefits (partner discounts, merchandise pricing, invitations to events, Early Bird Promotions and similar benefits) and, as part of that membership, receive a monthly allocation of promotional Tickets to a Ticket Balance, which the member may use to enter eligible Promotions run by Rewardom from time to time.
1.2What Rewardom is not. Rewardom does not operate a casino, provide wagering products, offer betting services, or operate games of chance for stake. Rewardom is not a lottery. Members are not "buying tickets": subscription fees are consideration for the platform-access member benefits described below, and Tickets are provided as a promotional bonus attached to that platform access, in accordance with the trade promotion regimes of the Australian States and Territories.
1.3Trade promotion model. All Australian Promotions are designed and operated as promotional prize draws (trade promotions) under the Australian Consumer Law and the trade promotion regimes of the relevant States and Territories. Rewardom obtains and displays all permits, authorities or licences required in each jurisdiction, and complies with all applicable permit conditions.
1.4No purchase necessary. For every Australian Promotion, Rewardom offers a genuine Free Entry Method throughout the Promotion Period (section 12). Paying a membership fee, or purchasing an Access Package, is never the only way to enter a Promotion.
1.5Tickets and platform access. Tickets are promotional entries only. A "Ticket" is a unique promotional entry, which the member may allocate to an eligible Promotion of the member's choice, subject to these Terms and the applicable Promotion Schedule. Tickets have no cash value, are not securities or financial products, cannot be redeemed for cash, and cannot be transferred, sold, assigned, exchanged, gifted or refunded, except as expressly permitted by these Terms or applicable law.
1.6Fairness. Each valid Ticket allocated to a Promotion has an equal chance of winning that Promotion. Rewardom applies internal controls designed to prevent entry manipulation, duplicate accounts, automated/bot entry, and fraudulent referrals.
1.7Member acknowledgment. By becoming an Active Member, you acknowledge and agree that: (a) your Loyalty Membership fee is paid in consideration for platform access, partner discounts, merchandise pricing, event invitations, Early Bird Promotions and the other Member Benefits described in section 7; (b) Tickets credited to your Ticket Balance are provided as a promotional bonus attached to that platform access, not as the primary thing being purchased; (c) you understand that the Free Entry Method (section 12) is genuinely available to you for every Australian Promotion, without any requirement to pay a fee or hold a Loyalty Membership; and (d) Rewardom does not operate a lottery, wagering, gambling or gaming service.
1.8Not a licensed gambling operator. Rewardom does not hold, and does not purport to hold, any casino, wagering, bookmaker, gaming machine, keno, lottery or minor gaming licence in any Australian jurisdiction, and does not offer any of those services. Any suggestion, whether by a member, a third party or a promotional partner, that Rewardom operates such services is incorrect.

3. Acceptance and hierarchy
3.1Acceptance. By creating an Account, purchasing or renewing a Loyalty Membership, purchasing an Access Package, accessing the Platform, or entering a Promotion, you confirm that you have read, understood and agree to be bound by these Terms and the relevant Promotion Schedule.
3.2If you disagree. If you do not agree to these Terms, you must not create an Account, purchase a Loyalty Membership or an Access Package, or enter any Promotion.
3.3Promotion Schedule. Each Promotion Schedule forms part of these Terms in respect of the relevant Promotion.
4. Eligibility
4.1Eligibility criteria. Unless a Promotion Schedule expressly states otherwise, Promotions are open only to individuals who:
- are 18 years of age or older at the time of entry;
- are Australian residents;
- are not employees, officers, contractors or agents of Rewardom, its related bodies corporate, its promotional agencies, or any supplier of prizes for the relevant Promotion (or an immediate family or household member of any such person); and
- satisfy any additional eligibility conditions set out in the relevant Promotion Schedule.
4.2Age verification at registration. During Account creation, you must confirm that you are 18 years of age or older. Rewardom may implement additional age verification measures at any time, including age-gate declarations at signup, credit card BIN verification, and government-issued identification checks. If Rewardom has reasonable grounds to suspect that a member is under 18, Rewardom will immediately suspend the Account, void any Tickets and Ticket allocations connected to that Account, and refund all Loyalty Membership and Access Package fees paid, in accordance with applicable law.
4.3Identity verification. Rewardom may require proof of identity, age, residency and lawful ownership of the payment instrument used, including government-issued identification and reasonable supporting documents, at any time during your membership and in any event before payment of a prize. If you do not provide satisfactory verification within the timeframe Rewardom reasonably specifies, Rewardom may (acting reasonably) suspend or terminate your Account, void entries and/or withhold a prize, to the extent permitted by law and any applicable permit conditions.
4.4Jurisdictional exclusions. Some Promotions may exclude entrants from particular Australian States or Territories where a permit has not been obtained, where a permit condition requires exclusion, or where required by law. Any such exclusion will be stated in the Promotion Schedule. Entrants must not enter a Promotion from which they are excluded.
5. Account rules and platform integrity
5.1Accurate information. You must provide accurate, complete and current information when creating your Account and keep those details up to date (including your email address, phone number and postal address).
5.2One person, one Account. Unless Rewardom expressly permits otherwise, each individual may hold only one Account at any time. Creating or operating multiple Accounts to gain additional Tickets is prohibited.
5.3No automation. You must not use bots, scripts, emulators, automation tools, or any method designed to mass-enter Promotions, auto-complete Daily Tasks, harvest referrals, or manipulate Platform metrics.
5.4Abuse and fraud. Rewardom may (acting reasonably) suspend, restrict or terminate an Account, and void the affected Tickets, where it reasonably suspects fraud, manipulation, exploitation of bugs, referral abuse, payment abuse, chargeback abuse, or breach of these Terms.
5.5Integrity controls. Rewardom may apply reasonable entry limits per person, household, device, IP address or payment instrument, and may require additional verification where unusual patterns are detected.
6. Loyalty Membership tiers
6.1Subscription-based membership. Loyalty Membership is an ongoing subscription to the Rewardom Platform, direct-debited from your nominated payment card on a monthly recurring basis until cancelled by you or terminated by us in accordance with these Terms. Fees are billed in advance and are inclusive of GST. Rewardom accepts payment by credit or debit card only.
6.2Membership Tiers. Rewardom currently offers three Loyalty Membership Tiers, as summarised in the table below. Rewardom may vary tier names, pricing, benefits and Ticket allocations from time to time in accordance with section 28 (which requires 30 days' prior notice and a right to cancel without penalty for material adverse changes).
| Entry | Premium | Elite | |
|---|---|---|---|
| Monthly fee (AUD, inc. GST) | A$19.99 | A$49.99 | A$99.99 |
| Monthly Ticket allocation credited to Ticket Balance | 5 Tickets | 20 Tickets | 50 Tickets |
| Access to partner "Mates Rates" discounts | Access | Access | Access |
| Discount on Rewardom-branded merchandise | 15% | 20% | 25% |
| Invitations to Rewardom events and experiences | General invites | Priority invites | VIP invites |
| Early Bird Promotion access (early/priority access to selected partner offers) | Standard | Enhanced | First access |
| Eligibility to purchase Access Packages (top-ups) | Yes | Yes | Yes |
| Early Bird Email | Yes | Yes | Yes |
6.3What you pay for. The Loyalty Membership fee is consideration for the Member Benefits described in section 7. Tickets credited to your Ticket Balance are provided as a promotional bonus that accompanies an active paid Loyalty Membership. The Loyalty Membership is not a purchase of Tickets, and Tickets are not offered for sale on a standalone basis.
6.4Monthly Ticket allocation. On each successful monthly billing of your Loyalty Membership at a given Membership Tier, the number of Tickets specified for that Tier is credited to your Ticket Balance. Tickets credited to your Ticket Balance are subject to section 8 (Ticket Balance).
6.5Membership does not improve odds. A higher Membership Tier gives you a larger monthly Ticket allocation; it does not change the odds attached to any individual Ticket. Each valid Ticket allocated to a Promotion has an equal chance of winning that Promotion.
6.6Consumer guarantees. Nothing in this section 6 limits any non-excludable rights or remedies you may have under the ACL or other applicable Australian law.
7. Member Benefits
7.1Partner discounts ("Mates Rates"). Active Members may access discount offers made available by third-party commercial partners under standard marketing or affiliate arrangements. Partners may include national brands and small-to-medium enterprises across sectors such as retail, hospitality, food and beverage, consumer goods, technology and services. Discounts may be offered online or in-store and vary by partner. Rewardom does not guarantee any particular discount value, frequency, partner availability or continuity of any particular partner offer.
7.2Rewardom Merchandise and member pricing. Rewardom sells Rewardom-branded merchandise directly (for example, apparel and accessories such as t-shirts, caps and similar items). Active Members may access member pricing at the tiered discount specified in the tier table above. Stock availability and product range may vary from time to time. Rewardom Merchandise is sold subject to a separate merchandise supply policy published on the Platform.
7.3Invitations to Rewardom events. Rewardom may invite Active Members to invitation-only, in-person social events (for example, dinners, festivals, gatherings and brand experiences). These events are not online games, gambling activities, or games of chance. Participation is subject to any event-specific terms, capacity limits and reasonable behaviour standards.
7.4Early Bird Promotions. Early Bird Promotions provide eligible Active Members with early or priority access to selected partner offers, promotions or product releases. Early Bird Promotions do not change draw mechanics, Ticket allocation or winner selection for any Promotion unless a Promotion Schedule expressly states otherwise.
7.5No guarantee. Rewardom does not guarantee that any specific Member Benefit will be available at any specific time, or that any particular partner will remain part of the partner network. Member Benefits are subject to change in accordance with section 28.
8. Ticket Balance
8.1What the Ticket Balance is. Your Ticket Balance is the running total of unspent, unexpired Tickets and Bonus Tickets held in your Account. Your Ticket Balance is visible in the Platform and updated in real time as Tickets are credited, allocated to Promotions, or expire.
8.2Allocating Tickets to Promotions. For each eligible Promotion during the Promotion Period, you may allocate one or more Tickets from your Ticket Balance to that Promotion, up to any per-Promotion cap stated in the Promotion Schedule. Once a Ticket has been allocated to a Promotion and the Promotion Period has closed, that allocation is final and the Ticket cannot be reallocated, refunded or returned to the Ticket Balance.
8.3No cash value; not transferable. Tickets held in the Ticket Balance have no cash value, are not a stored-value or financial product, cannot be redeemed for cash, and cannot be transferred, sold, assigned, gifted or exchanged between Accounts.
8.4Expiry and forfeiture. Each Ticket expires 12 months after the date on which it is credited to your Ticket Balance ("rolling expiry"), unless earlier allocated to a Promotion. Expired Tickets are removed from the Ticket Balance and cannot be reinstated. On cancellation or termination of your Loyalty Membership, your Ticket Balance is forfeited in full, except that Rewardom will preserve the Ticket Balance for a period of 30 days from the effective date of cancellation to allow for reactivation; if the Loyalty Membership is reactivated within that 30-day window, the Ticket Balance (less any Tickets that expired under the rolling expiry rule during the window) is restored.
8.5Order of use. When you allocate Tickets to a Promotion, Tickets are drawn from your Ticket Balance in the order of earliest expiry first, so that Tickets nearer to expiry are used before Tickets with a longer remaining life.
8.6No refunds. Rewardom does not issue refunds for Tickets, including Tickets that expire unused, Tickets allocated to Promotions from which the member is subsequently disqualified for breach of these Terms, or Tickets forfeited on cancellation, except where required by the ACL or other applicable law.
9. Access Packages (top-ups)
9.1What Access Packages are. An Access Package is a one-off, short-duration extension of platform access that an Active Member may purchase in addition to the member's ongoing Loyalty Membership. Each Access Package grants the purchaser a defined number of additional days of continued platform access at the member's current Membership Tier, with a defined number of bonus Tickets credited to the purchaser's Ticket Balance as a promotional bonus attached to that platform access. Access Packages are not offered as standalone Ticket sales.
9.2Eligibility. Access Packages may be purchased only by Active Members whose Loyalty Membership is current and in good standing. Access Packages are not available to non-members, to members whose Loyalty Membership is in the payment grace period described in section 21, or to members whose Account is suspended.
9.3Package specifications. The current Access Package specifications (including price, extended-access days and attached bonus Tickets) are published on the Platform and may be varied by Rewardom from time to time in accordance with section 28. All Access Package prices are inclusive of GST.
9.4Application of extended access days. Extended-access days purchased through an Access Package are queued and applied consecutively at the end of the member's current Loyalty Membership billing cycle. If the member cancels or downgrades the Loyalty Membership before the extended-access days are consumed, the extended-access days continue to run at the Membership Tier held at the time the Access Package was purchased, until exhausted.
9.5Bonus Tickets attached to Access Packages. Bonus Tickets attached to an Access Package are credited to the member's Ticket Balance immediately on successful payment. Bonus Tickets from Access Packages are subject to section 8, including the rolling 12-month expiry rule.
9.6Non-refundable. Access Packages are non-refundable once purchased, except where required by the ACL or other applicable law. Bonus Tickets attached to an Access Package have no independent cash value and cannot be refunded separately from the underlying Access Package.
9.7Purchase limits. Rewardom may (acting reasonably) apply per-member, per-household or per-payment-instrument caps on the number or aggregate value of Access Packages purchasable within a given period, to preserve fairness and platform integrity. Any such caps will be published on the Platform.
10. Rewardom Merchandise
10.1Direct sales. Rewardom sells Rewardom-branded merchandise directly to consumers via the Platform. Merchandise is priced at ordinary retail value. Active Members receive the tiered discount set out in the tier table.
10.2Merchandise-linked Bonus Tickets. From time to time, Rewardom may offer Bonus Tickets into one or more Promotions as a promotional bonus attached to the purchase of specified Rewardom Merchandise. The Merchandise itself is the product being supplied; the Bonus Tickets are a promotional add-on provided free of additional charge. Any Merchandise offered in connection with Bonus Tickets will be priced at its ordinary retail value.
10.3Consumer guarantees. Rewardom Merchandise is sold with the Consumer Guarantees applicable under the ACL. Refunds and returns for Merchandise are handled in accordance with Rewardom's merchandise supply policy published on the Platform.
11. Promotions framework
11.1Major Draws and Minor Draws. Rewardom conducts one Major Draw per calendar month and between 5 and 20 Minor Draws per calendar month, and may from time to time conduct additional one-off or campaign-specific Promotions. Each Promotion has its own Promotion Schedule, which specifies the Promotion Period, draw date, prize(s) and any tier or eligibility conditions.
11.2Mandatory Promotion Schedule. Each Promotion has a Promotion Schedule that states: the Promotion Period start and end times (Australian Eastern Time); the draw date, time and method; the prizes and total prize value; eligibility criteria and any jurisdictional exclusions; how to enter (including the FEM); any Ticket allocation caps; winner notification and publication arrangements; the claim period and unclaimed-prize/redraw arrangements; and all applicable permit, authority or licence numbers.
11.3Permits and authorities. Rewardom will obtain, maintain and prominently display all trade promotion permits, authorities and licences required in each Australian State or Territory in which each Promotion is conducted, and will comply with all applicable permit conditions. Where required by law or permit conditions, the applicable permit or authority number will appear on the relevant Promotion Schedule and in advertising material for that Promotion. A publicly accessible register of current permits and authorities is maintained on the Platform, updated within seven (7) days of any grant, renewal or expiry.
11.4Advertising and disclosures. Rewardom promotional communications will (where required by law or permit conditions): (a) direct participants to the full Promotion Schedule and these Terms; (b) include the relevant permit or authority numbers where applicable; and (c) clearly disclose any unusual or onerous conditions (including eligibility exclusions, claim deadlines, verification steps and material prize limitations).
11.5Record-keeping. Rewardom will retain entry records, verification logs, referral logs, draw outputs and prize-fulfilment evidence for at least three (3) years after the conclusion of each Promotion, or longer where required by applicable law or permit/authority conditions.
12. Free Entry Method (FEM)
12.1Free Entry Method. For every Australian Promotion, Rewardom offers a genuine Free Entry Method throughout the Promotion Period. The Free Entry Method requires no purchase, no Loyalty Membership, no Access Package, and no other consideration. Entries obtained via the Free Entry Method are treated identically to Tickets allocated by paying members and have the same chance of winning as any other valid entry.
12.2Prominence. A clear and reasonably prominent link to Free Entry Method instructions will be displayed: (a) on each Promotion landing page, above the fold and in text no smaller than the surrounding body text; (b) in each promotional communication sent by Rewardom to potential entrants for that Promotion; and (c) on the Rewardom Platform homepage in the footer navigation. The Free Entry Method link and instructions must be genuinely accessible and will not be located behind login walls, unlabelled drop-down menus, or otherwise obscured.
12.3Method - postal entry. To enter a Promotion via the Free Entry Method, an eligible entrant must hand-write their entry on a piece of paper (A4 or smaller) containing the following, clearly legible:
- the entrant's full name;
- the entrant's residential postal address (including State/Territory and postcode);
- the entrant's email address and daytime telephone number; and
- the exact name of the Promotion into which the entrant wishes to enter.
12.4Postal address. The completed entry must be sent by ordinary or first-class post to:
Rewardom Scrutineer - [PROMOTION NAME]c/- [SCRUTINEER NAME][PO BOX ADDRESS][SUBURB STATE POSTCODE], Australia
12.5Timing. A postal entry must be postmarked before the close of the Promotion Period and received by the scrutineer within five (5) business days of the draw date to be eligible. Entries received after that time will not be included in the draw.
12.6Entry limit. One (1) free postal entry per household per Promotion. Multiple free postal entries from the same household will be treated as a single entry for that Promotion. Entries that are illegible, incomplete or that do not clearly identify the Promotion will be void.
12.7Independent handling. Postal entries are received, logged and inserted into the draw pool by an independent scrutineer. Rewardom staff do not open, handle or process postal entries.
12.8No costs recovered. Entrants using the Free Entry Method bear their own postage costs. Rewardom does not reimburse postage costs.
13. How to enter (Ticket allocation)
13.1Entry routes. For each Australian Promotion, entries may be allocated through one or more of the following routes, each as further described in the Promotion Schedule:
- Tickets allocated from your Ticket Balance under section 8;
- Bonus Tickets attached to an Access Package purchased under section 9;
- Bonus Tickets attached to a Rewardom Merchandise purchase under section 10;
- Bonus Tickets from Daily Tasks (section 14);
- Bonus Tickets from referrals (section 15); and
- the Free Entry Method described in section 12 (available to all eligible entrants, whether or not they hold a Loyalty Membership).
13.2Ticket allocation. To allocate Tickets from your Ticket Balance to a specific Promotion, log in to the Platform, navigate to the relevant Promotion, and select the number of Tickets you wish to allocate. Ticket allocation is confirmed on screen and by email or in-app notification.
13.3Cap per Promotion. Rewardom may apply a per-member cap on the number of Tickets that may be allocated to any single Promotion (a "Per-Promotion Cap"). Any Per-Promotion Cap will be published in the Promotion Schedule.
13.4Cut-off. Ticket allocation to a Promotion closes at the end of the Promotion Period stated in the Promotion Schedule. Tickets not allocated to a Promotion by the cut-off remain in the Ticket Balance and may be allocated to a subsequent eligible Promotion, subject to expiry under section 8.4.
13.5Equal chance. Each valid Ticket allocated to a Promotion, however obtained, has an equal chance of winning that Promotion.
14. Daily Tasks and Bonus Tickets
14.1Optional engagement. Daily Tasks are optional engagement actions within the Platform which, if completed and verified, may result in the allocation of Bonus Tickets to your Ticket Balance. Examples may include logging in to the Platform, viewing partner content, or completing platform interactions clearly described in-app.
14.2Automated verification. Daily Task completion is automatically verified by Rewardom systems. Where verification fails or is inconclusive, Rewardom may withhold Bonus Tickets or require further evidence of completion.
14.3No paid chance mechanics. Rewardom does not offer online "instant win" games or paid chance-based Bonus Ticket allocations. Any game-like animations or visuals on the Platform are for presentation only and do not involve chance-based outcomes for allocating Bonus Tickets, unless a Promotion Schedule expressly states otherwise and doing so is permitted by law.
14.4Caps. Rewardom may introduce reasonable caps on Bonus Tickets allocated through Daily Tasks to maintain fairness and platform integrity. Any applicable caps will be published in-app.
15. Referrals
15.1Referral Bonus Tickets. Where offered, referral Bonus Tickets may be credited to your Ticket Balance when a referred individual completes the qualifying steps stated in the referral rules (for example, account creation, first Loyalty Membership payment and eligibility verification).
15.2Anti-abuse. Self-referrals, duplicate or fake accounts, device farming, incentivised sign-ups that breach these Terms, or any other referral manipulation are prohibited. Rewardom may void referral Bonus Tickets and take any Account action available under section 5.
16. Winner selection, draw system and methodology
16.1RNG-based random draw. All winners are selected by a random number generator (RNG) from the pool of valid Tickets in the relevant Promotion, in accordance with the draw method disclosed in the Promotion Schedule. Rewardom uses an internally developed automated draw system that randomly selects winners after the entry pool for a Promotion has been finalised. Once entries are finalised, the selection runs without manual intervention.
16.2Methodology disclosure. Rewardom documents the draw methodology and references it on each draw page and/or in the Promotion Schedule. The RNG is deterministic once seeded, and the seed source is documented in Rewardom's internal draw records.
16.3Independent RNG testing. The random number generator used by Rewardom is periodically tested and certified by an independent testing laboratory recognised for RNG certification in the prize competition and gaming industries (such as iTech Labs, Gaming Laboratories International or BMM Testlabs). Current certification status is documented in Rewardom's internal draw records and made available to independent scrutineers, regulators or auditors on request.
16.4Independent scrutineer for high-value Promotions. For any Promotion with a total prize pool exceeding A$50,000, an independent scrutineer will be present at the draw. The scrutineer verifies the entry pool, the RNG seed, the draw execution and the winner selection. The scrutineer's certification is published on the Promotion page within seven (7) days of the draw. For all other Promotions, Rewardom may appoint an independent scrutineer or implement additional audit controls, and will do so where required by permit conditions.
17. Prizes, procurement and fulfilment
17.1Prizes as advertised. Prize details are set out in the Promotion Schedule. Images are illustrative only unless expressly stated otherwise.
17.2Procurement. Physical prizes (including high-value items such as vehicles and real estate) are procured directly from third-party suppliers prior to the draw being conducted, unless the Promotion Schedule expressly states a permitted alternative.
17.3Cash prizes. Cash prizes are funded from Rewardom operational accounts and distributed via standard banking channels (for example, electronic funds transfer to a bank account held in the winner's name).
17.4Prize acceptance and verification. Winners must complete identity, age and eligibility verification and provide required information for delivery or transfer of the prize. Rewardom applies a tiered verification protocol scaled to prize value: (a) for prizes with a retail value of A$5,000 or less, verification by government-issued photo identification and address match; (b) for prizes with a retail value exceeding A$5,000 but not exceeding A$10,000, verification via a 100-point identification check (of the type contemplated by the Financial Transaction Reports Regulations 1990 (Cth), Schedule 1); and (c) for prizes with a retail value exceeding A$10,000, a 100-point identification check together with sanctions and politically-exposed-person screening via a recognised commercial provider (such as Refinitiv or Dow Jones). Prize delivery is contingent on satisfactory completion of the applicable verification within the claim period.
17.5Vehicle prize practicalities. Promotion Schedules for vehicle prizes will specify whether registration, stamp duty, insurance, delivery and other on-road costs are included or excluded; delivery location(s) and timeframes; and any limitations on colour, trim or model changes.
17.6Prize collection from HQ. Where a Promotion Schedule provides that a prize cannot be delivered to a winner in a particular State or Territory (for example, due to permit conditions or state-specific delivery restrictions), the winner may be required to collect the prize from Rewardom's nominated collection point at the winner's own cost.
17.7No fees to claim. Rewardom will never charge a winner a fee to claim a prize.
17.8Substitution. Rewardom will not substitute a prize except where permitted by law and stated in the Promotion Schedule, and generally only with an alternative of equal or greater value, or with the winner's consent where required by law or permit conditions.
17.9Tax. Winners are responsible for any tax consequences associated with a prize, and should seek independent advice where appropriate.
18. Winner notification, publication, claim period and redraws
18.1Notification. Winners will be notified using the contact details linked to their Account within the timeframe stated in the Promotion Schedule.
18.2Publication. Rewardom may publish winner information (for example, initials and State/suburb) where stated in the Promotion Schedule and/or required by law or permit conditions.
18.3Claim period. Winners must claim prizes within the claim period stated in the Promotion Schedule.
18.4Redraws / unclaimed prizes. If a winner is ineligible, cannot be contacted after reasonable efforts, or does not claim within the claim period, Rewardom may conduct a redraw where permitted, and in accordance with the Promotion Schedule and applicable permit conditions.
19. Errors, misprints and platform issues
19.1Reasonable steps. Rewardom will take reasonable steps to ensure the accuracy of Promotion information. If there is a manifest error (for example, obvious mispricing, incorrect prize listing, or a technical issue allocating unintended Tickets), Rewardom may correct the error and take reasonable remedial steps consistent with applicable law and permit conditions.
19.2System incidents. If a system incident materially impacts the integrity of a Promotion (for example, entry database corruption), Rewardom may pause or reschedule a draw and will communicate the corrective action.
20. Prohibited conduct and enforcement
20.1Prohibited conduct. Prohibited conduct includes: operating multiple Accounts to gain additional Tickets; use of bots, scripts or other automation; exploitation of bugs; falsifying identity or verification information; collusion, tampering or any attempt to influence a draw outcome; referral manipulation; and payment or chargeback abuse.
20.2Enforcement. Rewardom may (acting reasonably): void Tickets and Ticket allocations; disqualify entrants; suspend or terminate Accounts; refuse to award or deliver prizes; and take any other action reasonably necessary to protect the integrity of a Promotion, where a breach of this section is substantiated.
21. Payment, cancellation and refunds
21.1Payment method. Loyalty Membership fees and Access Package fees are payable by credit or debit card only. By providing card details you authorise Rewardom (and its payment processor) to charge the applicable fees to that card on the applicable billing date until you cancel or the Loyalty Membership is terminated.
21.2Failed payment and grace period. If a scheduled payment fails, Rewardom will re-attempt the payment up to four (4) times over a period of twenty-one (21) days ("Grace Period"). During the Grace Period: (a) the member retains platform access and may allocate Tickets already held in the Ticket Balance to eligible Promotions; (b) no new monthly Ticket allocation is credited to the Ticket Balance until payment is successfully restored; and (c) Access Package purchases are not available. If no successful payment is received within the Grace Period, the Loyalty Membership will be terminated and section 8.4 (Expiry and forfeiture) applies.
21.3Cancellation by member. You may cancel your Loyalty Membership at any time via your Account settings. Cancellation takes effect at the end of the current billing cycle. Rewardom does not issue pro-rata refunds of already-paid Loyalty Membership fees, except where required by the ACL or other applicable law.
21.4Non-refundable. Loyalty Membership fees and Access Package fees are non-refundable except where required by the ACL or other applicable law. Refunds required by law will be processed to the original payment card, or by such other method as Rewardom may reasonably determine.
21.5Chargebacks. A chargeback initiated against Rewardom without prior contact with Rewardom customer support may result in: (a) suspension or termination of the Account; (b) void of all Tickets and Ticket allocations connected to the disputed payment; and (c) forfeiture of any prize won using those Ticket allocations. This clause does not limit any rights you may have under the ACL to seek a refund from your card issuer or from Rewardom directly.
21.6First-time subscriber cooling-off. A member subscribing to a Loyalty Membership for the first time may cancel and receive a full refund of the first month's Loyalty Membership fee if the member cancels within fourteen (14) days of the initial subscription and has not, during that period, allocated any Tickets to a Promotion or received any Prize from Rewardom. This cooling-off right is provided by Rewardom as a matter of policy in addition to any rights available under the ACL, and does not apply to Access Packages or renewals.
21.7ACL refunds. Nothing in this section 21 excludes, restricts or modifies any right to a refund or remedy available to you under the ACL or other applicable law. Where a refund is required by law, Rewardom processes the refund to the original payment card, or by such other method as Rewardom may reasonably determine.
22. Responsible Participation
22.1Overview. Although Rewardom does not operate a gambling, wagering or gaming service, Rewardom voluntarily maintains a Responsible Participation Framework designed to help members manage their engagement with the Platform and to protect vulnerable members.
22.2Voluntary spend limits. Members may set a voluntary monthly spend limit covering Loyalty Membership fees and Access Package purchases combined, via the Account settings. Once a member has set a spend limit, Rewardom will not process transactions during a calendar month that would cause total spend for that month to exceed the limit. A member may increase a voluntary spend limit only after a seven (7) day cooling-off period; decreases take effect immediately.
22.3Session and activity dashboards. Members can view a running summary of their Loyalty Membership tenure, cumulative Loyalty Membership fees paid, Access Packages purchased, Tickets credited, Tickets allocated and prizes won, via the Account dashboard.
22.4Self-exclusion. A member may request self-exclusion from the Platform for a nominated period of not less than six (6) months, via the Account settings or by emailing [email protected]. On self-exclusion: (a) the Loyalty Membership is cancelled; (b) any Ticket Balance is forfeited under section 8.4; (c) the Account is disabled for the self-exclusion period; and (d) Rewardom will not process any further transactions from the member during that period. Self-exclusion may not be revoked during the self-exclusion period.
22.5Help resources. Members concerned about their engagement with the Platform, or with paid subscription or prize-competition products generally, may contact Consumer Affairs in their State or Territory, the Financial Counselling Australia national helpline (1800 007 007), or Lifeline (13 11 14) for general support. These resources are provided for information; Rewardom does not warrant or endorse third-party services.
22.6Vulnerable members. Rewardom takes reasonable steps to identify and support members who may be in a vulnerable position, including through automated pattern monitoring, response to member notifications and reasonable action following third-party requests (for example, a family member notification). Nothing in this section obliges Rewardom to make clinical or diagnostic assessments.
23. Privacy and data handling
23.1Privacy Policy. Rewardom handles personal information in accordance with its Privacy Policy (available on the Platform) and applicable Australian privacy laws, including the Privacy Act 1988 (Cth), the Australian Privacy Principles and the Notifiable Data Breaches scheme. The Privacy Policy forms part of these Terms and members should read the Privacy Policy in conjunction with these Terms.
23.2Purposes. Rewardom collects, uses and discloses member and entrant personal information for the purposes set out in the Privacy Policy, which include: Account administration; Loyalty Membership and Promotion administration, verification and prize fulfilment; fraud prevention, sanctions screening and integrity monitoring; customer support and dispute handling; regulatory reporting and compliance; and, subject to consent where required, marketing.
23.3Cross-border disclosure. Rewardom uses service providers (for example, payment processors, cloud hosting, email delivery and identity verification providers) which may be located, or may process personal information, outside Australia. Details of the categories of overseas recipients and the jurisdictions in which they are located are set out in the Privacy Policy.
23.4Retention. Rewardom retains personal information for the periods described in the Privacy Policy. Records connected with the conduct of a Promotion are retained for at least three (3) years after the conclusion of that Promotion, in accordance with section 11.5, or longer where required by applicable law or permit conditions.
23.5Access, correction and complaints. Members may request access to, or correction of, their personal information, or make a privacy complaint, in accordance with the process set out in the Privacy Policy. Members may also make a privacy complaint directly to the Office of the Australian Information Commissioner.
24. Marketing communications
24.1Consent-based marketing. Rewardom sends marketing communications (including commercial electronic messages) only where the recipient has provided express or inferred consent for the purposes of the Spam Act. Consent is captured, evidenced and honoured in accordance with the Rewardom Privacy Policy.
24.2Sender identification. All Rewardom commercial electronic messages clearly identify Rewardom as the sender, including the registered business name (Fronk Enterprises Pty Ltd), ACN and contact details.
24.3Unsubscribe. Every marketing email includes a functional unsubscribe facility that is processed within five (5) working days. Members may also unsubscribe by: (a) updating notification preferences in the Account settings; or (b) emailing [email protected] with the subject line "Unsubscribe". Cancellation of your Loyalty Membership does not automatically remove you from marketing lists.
24.4Marketing content discipline. Rewardom promotional and marketing content (including landing pages, email campaigns, social media posts and paid advertising): (a) accurately describes Loyalty Membership as a paid subscription for platform access, discounts, merchandise pricing, event invitations and other Member Benefits; (b) accurately describes Tickets and Promotions as a promotional bonus attached to that platform access; (c) does not represent Rewardom as a lottery, gambling or gaming service; (d) does not overstate the odds of winning, misrepresent prize values, or make claims that are misleading or deceptive within the meaning of the ACL; and (e) discloses all material terms, including any jurisdictional exclusions and the availability of the Free Entry Method.
24.5Consent records. Rewardom retains records of marketing consent evidence for a minimum of three (3) years after the withdrawal of consent or the closure of the relevant Account, in accordance with the Privacy Policy.
25. Australian Consumer Law
25.1Non-excludable rights. Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the ACL or any other law that cannot be lawfully excluded, restricted or modified.
25.2Limitation of remedy. To the extent permitted by law, where a Consumer Guarantee applies to services supplied by Rewardom and Rewardom is liable for a failure to comply with it, our liability is limited (at our option) to the resupply of the services or the payment of the cost of having the services resupplied.
25.3Unfair contract terms. If any provision of these Terms is or becomes an unfair contract term within the meaning of the ACL, that provision is severable from these Terms in accordance with section 30.3 and the balance of these Terms continues in full force and effect.
26. Liability and disclaimers
26.1Consequential loss. To the maximum extent permitted by law, Rewardom is not liable for indirect or consequential losses (including loss of opportunity, loss of enjoyment or reputational loss) arising in connection with a Promotion or your use of the Platform.
26.2Platform availability. Rewardom does not guarantee uninterrupted access to the Platform. Scheduled maintenance and unplanned outages may occur from time to time.
26.3Third-party partners. Rewardom is not responsible for the acts or omissions of any third-party partner supplying discounts, offers or products through the Platform, except to the extent required by law.
27. Force majeure
27.1Force majeure event. A "Force Majeure Event" means any event or circumstance beyond the reasonable control of Rewardom, including acts of God, natural disasters, fire, flood, pandemic or public health emergency, war, terrorism, civil unrest, action of government or regulatory authority, industrial action, telecommunications or power failure, cyber-attack, or the failure or delay of a third-party supplier which itself is affected by a Force Majeure Event.
27.2Suspension of obligations. If Rewardom is prevented or delayed from performing any obligation under these Terms by a Force Majeure Event, that obligation is suspended for the duration of the Force Majeure Event. Rewardom will use reasonable endeavours to mitigate the effect of the Force Majeure Event on its members and to resume performance as soon as practicable.
27.3Promotions during Force Majeure Events. Where a Force Majeure Event materially impacts the conduct of a Promotion (including delivery of a prize), Rewardom may reschedule the draw, adjust the claim period, or take other reasonable remedial steps consistent with applicable law and permit conditions. Rewardom will notify affected entrants of any such action.
28. Changes to Terms and Promotions
28.1Non-material changes. Rewardom may update these Terms from time to time. Non-material changes (for example, drafting improvements, updated regulator contact details, or minor clarifications) will be published on the Platform with an updated "Last updated" date and take effect immediately.
28.2Material changes - notice period and right to cancel. Where a change to these Terms is material and adverse to members (including any increase in Loyalty Membership fees, any material reduction in Ticket allocations or Member Benefits, any change to Ticket expiry or forfeiture rules, or any change to refund entitlements), Rewardom will provide not less than thirty (30) days' prior written notice to the email address linked to each affected Account. During that notice period, affected members may cancel their Loyalty Membership without penalty and receive a pro-rata refund of any unused portion of the current billing period. Continued use of the Platform, or continued Loyalty Membership beyond the effective date of the change, constitutes acceptance of the amended Terms.
28.3Changes to Promotions. Rewardom may amend a Promotion Schedule only to the extent permitted by applicable law and permit or authority conditions. Where a jurisdiction restricts amendment, withdrawal or cancellation of a Promotion after it has commenced (including Western Australia where applicable), Rewardom will not amend, withdraw or cancel except as required by law or as approved by the relevant authority. Where NSW notification obligations apply, Rewardom will notify NSW Fair Trading of any substantial changes and will take reasonable steps to notify entrants where required.
29. Complaints and disputes
29.1How to complain. If you have a complaint, email [email protected] with the subject line "Complaint" and include your Account email address, the nature of the complaint, and (if applicable) the Promotion name and draw date.
29.2Timing for draw-related complaints. Complaints regarding the conduct of a draw, the announcement of winners or the awarding of a prize must be submitted within ten (10) days of the relevant draw or publication of the winners (as applicable). Complaints received after this time will not be considered.
29.3Acknowledgment and response. Rewardom will acknowledge complaints within two (2) business days and aim to respond substantively within ten (10) business days. Where a complaint is complex or requires input from a third party, Rewardom will provide a status update within ten (10) business days and a substantive response within a further reasonable period.
29.4Escalation and good-faith negotiation. If a complaint is not resolved to the member's satisfaction, the parties will engage in good-faith negotiation for a period of not less than twenty-one (21) days before pursuing external escalation.
29.5External dispute resolution. Nothing in these Terms prevents you from contacting the relevant consumer, privacy or gaming regulatory body, including NSW Fair Trading, Consumer and Business Services (SA), Consumer Affairs Victoria, the ACT Gambling and Racing Commission, Consumer Affairs Northern Territory, the Western Australia Department of Local Government, Sport and Cultural Industries, or the Office of the Australian Information Commissioner. If Rewardom services fall within the jurisdiction of AFCA, you may also refer the dispute to AFCA in accordance with AFCA's rules.
30. General provisions
30.1Entire agreement. These Terms (together with each Promotion Schedule, the Rewardom Privacy Policy and any policies expressly incorporated by reference) constitute the entire agreement between you and Rewardom in relation to the subject matter of these Terms, and supersede all prior agreements, representations and understandings.
30.2Assignment and novation. You may not assign, transfer or novate your rights or obligations under these Terms. Rewardom may assign, transfer or novate its rights and obligations under these Terms to any related body corporate or to any purchaser of the Rewardom business, provided that the transferee agrees to be bound by these Terms. Rewardom will provide members with reasonable notice of any assignment, transfer or novation.
30.3Severability. If any provision of these Terms is or becomes invalid, illegal or unenforceable in any jurisdiction, that provision will be severed to the minimum extent necessary and the remaining provisions will continue in full force and effect. If a provision cannot be severed without materially affecting the balance of the Terms, the parties will negotiate in good faith to replace it with a valid, enforceable provision that achieves substantially the same commercial outcome, so far as the ACL and applicable law permit.
30.4No waiver. A failure or delay by Rewardom to exercise any right or remedy under these Terms is not a waiver of that right or remedy. A waiver by Rewardom of any breach of these Terms does not operate as a waiver of any subsequent breach.
30.5Notices. Notices from Rewardom to you may be given by email to the address linked to your Account, by notification in the Platform, or by post to your registered address. Notices from you to Rewardom must be given by email to [email protected] or by post to the registered address in section 32. Notices are deemed received on the business day after they are sent (email or in-Platform notification) or five (5) business days after posting.
30.6Language. These Terms are drafted in English. Any translation of these Terms provided by Rewardom is provided for convenience only and, in the event of any inconsistency, the English version prevails.
30.7Interpretation. Headings in these Terms are for convenience only and do not affect interpretation. Words in the singular include the plural and vice versa. "Including" and "for example" are not words of limitation. A reference to a statute includes any amendment, replacement or successor statute.
31. Governing law
These Terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of that jurisdiction and the courts entitled to hear appeals from them.
